Present — Nolan, P.J., Carswell, Johnston, MacCrate and Schmidt, JJ.

In an action under the Jones Act (U.S. Code, tit. 46, § 688) to recover damages for the wrongful death of decedent, a marine engineer employed by defendant, defendant appeals from a judgment entered on a verdict in favor of plaintiff. Decedent allegedly met his death when he fell into the water from a gangplank leading from a pier to the ferryboat where he was to report for duty. Judgment unanimously affirmed, with costs. ( Lavender v. Kurn, 327 U.S. 645; Murphy v. Boston Maine R.R., 319 Mass. 413.)
