Owens-Illinois, Inc. v. Hoagland

District Court of Appeal of Florida, Fifth District
Jan 8, 1987
499 So. 2d 940 (Fla. Dist. Ct. App. 1987)

Opinion

No. 86-1936.

January 8, 1987.

Petition for Writ of Certiorari. A Case of Original Jurisdiction.

John S. McEwan, II, of Sanders, McEwan, Mims Martinez, P.A., Orlando, for petitioners.

John R. Overchuck, Orlando, Vanessa L. Volpe, Miami, Ronald Webster, Mary C. McDaniel, Leesburg, and J. Scott Murphy, Orlando, for respondents.

This petition for writ of certiorari is granted. The order of the circuit court requiring production is overly broad and quashed without prejudice to the entry of an order compelling discovery limited to items relating to the specific type of bottle and cap involved in the incident which forms the basis of the complaint.

UPCHURCH, C.J., and SHARP and COWART, JJ., concur.
