MASTER AND SERVANT, § 59 — evidence warranting judgment for commissions. In action to recover commissions allegedly due under agreement whereby plaintiff was employed by defendant as a traveling salesman of ladies' garments without any understanding as to duration of employment, evidence justified judgment for plaintiff on ground that he was employed by defendant to represent defendant in sale of defendant's fall 1946 line, that plaintiff performed services in defendant's behalf in connection with such line, that as result of plaintiff's efforts a substantial amount of merchandise was sold by defendant, that after plaintiff's services were substantially completed defendant discharged plaintiff for reasons patently false, and that defendant then sought to reap benefit of plaintiff's labors and to escape payment of commissions to which plaintiff was entitled.
