ORDER MODIFYING OPINION
On December 1, 2005, we issued an opinion denying appellant's motion for stay pending appeal supported by alternate security. We hereby modify our opinion by adding the following sentences to the end of footnote 4:
See Nelson v. Heer, 121 Nev. ___, 122 P.3d 1252 (2005).
To the extent that State ex rel. PSC v. District Court, 94 Nev. 42, 44-46, 574 P.2d 272, 273-74 (1978), implies otherwise, it is disavowed. PSC's requirement that the State or a state agency file a motion for stay pending appeal is not in any way affected by this opinion, however. Id. at 45-46, 574 P.2d at 274.
