ORDER DISMISSING APPEAL
Pursuant to the stipulation of the parties, this appeal is hereby dismissed.
The stipulation also recites that our earlier opinion in this appeal will be vacated. The opinion was already recalled, however, in our order of February 16, 1983.
Respondent shall have twenty (20) days from the filing of this order to file a supplemental answering brief, in response to the brief of amicus curiae.

ORDER GRANTING REHEARING
Good cause appearing, and pursuant to NRAP 40, rehearing is hereby granted. Our opinion in this matter, Montgomery v. Royal Motel, 98 Nev. 240, 645 P.2d 968 (1982), is hereby recalled.
Cause appearing, and pursuant to NRAP 29, the motion of the Nevada Trial Lawyers' Association for leave to appear as amicus curiae on behalf of appellants is hereby granted, and the clerk of this court is directed to file the NTLA's amicus curiae brief. 1
The court has determined that this matter should be reargued. Accordingly, oral argument is hereby scheduled for Friday, April 15, 1983, at 9:15 a.m., at the North Las Vegas City Commission Chamber. Appellant and amicus shall each have fifteen minutes for argument; respondent shall have thirty minutes.
