Monsey Manufacturing Co. v. Ocko

Court of Appeals of the State of New York
May 2, 1963
191 N.E.2d 93 (N.Y. 1963)

Opinion

Argued March 25, 1963

Decided May 2, 1963

Appeal from the Appellate Division of the Supreme Court in the Second Judicial Department.

David H. Moses and John L. Mirabile for appellant.

Sidney Schwartz and Robert H. Freilich for respondents.

Judgment reversed and complaint dismissed, with costs in this court and in the Appellate Division. The variance, reasonably read and as intended and interpreted by the Zoning Board of Appeals, validated all the activities carried on in appellant's cold storage building except the storage of nonfarm products which storage has apparently been discontinued. We pass upon no other question. No opinion.

Concur: Chief Judge DESMOND and Judges DYE, FULD, VAN VOORHIS, BURKE, FOSTER and SCILEPPI.
