Opinion

Case No. SC04-368.

July 6, 2005.

Lower Tribunal No. 1D03-1518.

Upon review of the responses to this Court's order to show cause dated March 2, 2005, the Court has determined that it should decline to exercise jurisdiction in this case. See Hale v. State, 891 So. 2d 517 (Fla. 2004). The petition for discretionary review is, therefore, denied.

No motion for rehearing will be entertained by the Court. See Fla.R.App.P. 9.330(d).

PARIENTE, C.J., and WELLS, ANSTEAD, CANTERO and BELL, JJ., concur.
