Judgment of the Municipal Court reversed and new trial ordered, costs to abide the event, on the authority of Harvard Company v. Wicht ( 99 App. Div. 507). Hirschberg, P.J., Bartlett, Woodward, Jenks and Hooker, JJ., concurred.
