Decision of this court in the above case, handed down March 3, 1943 [ 265 App. Div. 556], corrected to read as follows: Orders denying motions for summary judgment reversed on the law and facts with ten dollars costs and disbursements on one appeal and motions for summary judgment granted, with ten dollars costs. Opinion by Hill, P.J. Bliss, Heffernan and Schenck, JJ., concur; Crapser, J. dissents, and votes to affirm the orders appealed from upon the ground that there are so many misstatements and cross-statements in the papers that a trial should be had and an opportunity to cross-examine should be given.
