All concur, except Dowling and McCurn, JJ., who dissent and vote for reversal on the law and facts and for granting a new trial, on the authority of Matter of Sadow ski, 246 App. Div. 490, and Matter of Maiden, 284 N.Y. 429. (The decree awards letters of administration of decedent's estate.)
