Court of Appeals of the State of New York
Dec 20, 1976
359 N.E.2d 1368 (N.Y. 1976)

Opinion

Argued November 18, 1976

Decided December 20, 1976

Appeal from the Appellate Division of the Supreme Court in the Second Judicial Department, MARIO PITTONI, J.

James J. Brady and Eugene M. Kaufman for appellant.

Peter J. Mastaglio and Thomas M. Lamberti for respondents.

Order affirmed, without costs (Matter of Anderson v Board of Educ., 38 N.Y.2d 897). There is nothing in this record to suggest that appellant's probationary appointment was terminated for a constitutionally impermissible purpose or in violation of statutory proscription (James v Board of Educ., 37 N.Y.2d 891, 892).

Concur: Chief Judge BREITEL and Judges JASEN, GABRIELLI, JONES, WACHTLER, FUCHSBERG and COOKE.
