Opinion

Decided February 23, 1984

On review of submissions pursuant to section 500.4 of the Rules of the Court of Appeals (22 N.Y.CRR 500.4), appeal dismissed, without costs, upon the ground that the order appealed from does not finally determine the proceeding within the meaning of the Constitution (see Matter of Brooklyn Union Gas Co. v Joseph, 297 N.Y. 469; Cohen and Karger, Powers of the New York Court of Appeals, § 12, p 52).
