Opinion
GIVAN, Chief Justice.
ORDER ACCEPTING AND APPROVING CONDITIONAL AGREEMENT FOR DISCIPLINE
Comes now the Disciplinary Commission of the Supreme Court of Indiana and Lee J. Christakis, respondent in this cause, and pursuant to Admission and Discipline Rule 23, § 11(d), tender to this Court a 'Conditional Agreement for Discipline,' which agreement more fully appears in words and figures as follows, to-wit:
(H.I.)
And this Court, being duly advised in the premises, finds that Lee J. Christakis, respondent in this cause, was convicted on May 10, 1974, by the United States District Court for the Northern District of Indiana, of having violated Title 18 U.S.C. § 111 (assaulting a federal officer); that by reason of such conviction, the respondent was sentenced to serve thirty (30) days of a six-month jail sentence, was placed on probation for three (3) years and was fined three thousand dollars ($3,000.00); that there is no evidence of record to demonstrate that the respondent knew the individual involved in the incident leading to his conviction was in fact a federal officer; and that the agreed discipline, to-wit: a thirty (30) days suspension from the practice of law, is appropriate under the circumstances of this case.
IT IS, THEREFORE, ORDERED, ADJUDGED, AND DECREED by this Court that the 'Conditional Agreement for Discipline' tendered in this cause is now accepted and approved and, in accordance with this agreement, the respondent, Lee J. Christakis, is hereby suspended from the practice of law in this State for a period of thirty (30) days, commencing May 1, 1976 and terminating May 30, 1976.
IT IS FURTHER ORDERED that the costs of this proceeding are to be assessed against the respondent, Lee J. Christakis, and that the reinstatement of respondent to the practice of law shall be conditioned only upon payment of such costs.
IT IS FINALLY ORDERED that the respondent, Lee J. Christakis, file in this cause an affidavit in accordance with Admission and Discipline Rule 23, § 26(b). The Clerk of this Court is directed to send a copy of this order to the Honorable Myron J. Hack, Hearing Officer, and the parties in this cause and their respective attorneys.
All Justices concur.
