ORDER


AND NOW, this 3rd day of August, 2007, after hearing oral argument and upon consideration of Plaintiff's Partial Motion for Summary Judgment (Document No. 37), Defendants' Motion for Summary Judgment (Document No. 39), and the responses thereto, it is hereby ORDERED that Plaintiffs' Motion for Partial Summary Judgment is DENIED and Defendants' Motion for Summary Judgment is GRANTED.

The Clerk of the Court is directed to mark this case closed for statistical purposes.
