The plaintiff's petition for certification for appeal from the Appellate Court, 58 Conn. App. 183 (AC 18119), is granted, limited to the following issue:

"Under the circumstances of the case, did the Appellate Court properly determine that the `American rule,' which prohibits the awarding of attorney's fees to a prevailing party except where allowed by statute or contractual provision, did not apply?"

The Supreme Court docket number is SC 16394.
