Arbitration — Award of arbitrators — Finality — Act of April 25, 1927, P. L. 381.

In this case in which it appeared that the plaintiff, a building contractor, brought an action in assumpsit against the owner of real estate for the balance allegedly due him under a certain written contract; and, in view of a provision in the contract for arbitration of disputes, the parties did, upon the suggestion of the court, agree to submit the matter to arbitration and thereafter a majority of a board of three arbitrators made an award to the plaintiff in a specified amount; and the court below dismissed the defendant's exceptions to the report and award and entered judgment in the amount of the award; and there was no averment of fraud or corruption by the arbitrators, it was Held that the court below had properly ruled, under the Act of April 25, 1927, P. L. 381, that the award could not be reviewed or set aside.

Appeal, No. 217, March T., 1960, from judgment of Court of Common Pleas of Allegheny County, April T., 1958, No. 3280, in case of Paul F. Majcher v. Herman J. Bronder. Judgment affirmed.

Assumpsit.

Opinion filed dismissing defendant's exceptions to majority report of arbitrators and judgment entered for plaintiff, opinion by DUFF, J. Defendant appealed.
