Luggage v. Rosenfeld

Court of Appeals of the State of New York
Mar 29, 1983
58 N.Y.2d 1063 (N.Y. 1983)

Opinion

Decided March 29, 1983

Appeal from the Appellate Division of the Supreme Court in the First Judicial Department, EDWARD H. LEHNER, J.

Gregory D. Frost for appellants.

Andrew J. Goodman for respondent.

On review of submissions pursuant to rule 500.2 (b) of the Rules of the Court of Appeals (22 N.Y.CRR 500.2 [g]), order affirmed, with costs. Appellants' claims with respect to the arbitrator's refusal to grant an adjournment raise no cognizable objection to the arbitration award, given our narrow scope of review (CPLR 7511, subd [b], par 1, cl [i]).

Concur: Chief Judge COOKE and Judges JASEN, JONES, WACHTLER, FUCHSBERG, MEYER and SIMONS.
