Petition for Allowance of Appeal No. 8 M.D. Allocatur Docket 1989 from the Order of the Commonwealth Court dated December 20, 1988, confirming its Opinion and Order entered on September 23, 1988, at No. 567 C.D. 1988, 120 Pa. Commw. 538, 548 A.2d 1295 (1988), affirming the Order of the Pennsylvania Board of Probation and Parole which recommitted Petitioner as a technical parole violator and assessed costs against Petitioner and Counsel; Madaline Palladino, Judge.


ORDER


AND NOW, to-wit, this 30th day of November, 1990, the Petition for Allowance of Appeal is granted. The order of the Commonwealth Court, 120 Pa. Commw. 538, 548 A.2d 1295, is affirmed. Pernell Smith v. Commonwealth, Pennsylvania Board of Probation and Parole, 524 Pa. 500, 574 A.2d 558 (1990).
