ORDER REGARDING REPORT AND RECOMMENDATION WITH REGARD TO DEFENDANTS' MOTIONS TO DISMISS


Upon de novo review, the Report and Recommendation of Magistrate Judge Kenneth P. Neiman dated October 28, 2002 is hereby adopted as summarized in Judge Neiman's conclusion. Docket No. 8 is hereby ALLOWED and Docket No. 11 is hereby ALLOWED, in part. The allegations against defendants Gallant and White, while thin, are sufficient to survive dismissal at this early stage.

The clerk will set the matter for a scheduling conference.

It is So Ordered.
