Further appellate review denied:

The application for further appellate review is denied. We express no opinion on whether claims of alleged "ineffective assistance of counsel" raised in the context of proceedings to classify sex offenders, G.L. c. 6, § 178K, are to be governed by the standard articulated in Commonwealth v. Saferian, 366 Mass. 89, 96 (1974). The majority of the Appeals Court properly determined that resolving that issue was unnecessary in the circumstances of this case. Cf. Commonwealth v. Sargent, 449 Mass. 576, 585-586 (2007). The question of what standard applies remains open.
