ORDER


After making an independent review of the pleadings, files and records in this case, and the Findings, Conclusions and Recommendations ("Findings") of the United States Magistrate Judge, I am of the opinion that the Findings are correct, with the following exception — the first full sentence on page 10 of the Findings is incorrect and should read: "And, the statute of limitations is tolled for 251 days for the period from October 15, 1998, when state habeas counsel filed a state habeas application, and June 23, 1999, when the Court of Criminal Appeals denied relief."

With that amendment, the Findings are correct and are ADOPTED as the Findings and Conclusions of this court.

SO ORDERED.
