ORDER


The Court has received proposed Findings and Recommendation from Magistrate Judge Henry L. Jones, Jr. After careful review of those findings and recommendation, and the timely objections received thereto, the Court concludes that the Findings and Recommendation should be, and hereby are, approved and adopted in their entirety with one exception. The Court determines that the findings should be amended to show that Officer J.R. Morgan is not a named defendant in this case.

IT IS THEREFORE ORDERED that the motion for summary judgment filed by defendant McQuilliams is hereby granted, and defendant McQuilliams is dismissed from plaintiff's complaint.

IT IS FURTHER ORDERED that the motion for summary judgment filed by the remaining ADC defendants is denied with respect to plaintiff's allegation of failure to protect, and granted with respect to plaintiff's allegations of deliberate indifference to his medical needs.
