MEMORANDUM OF DECISION


On August 23, 2005, the plaintiff filed a five-count amended complaint against the defendant seeking money damages, punitive damages and attorneys fees for certain conduct committed by the defendant as alleged in detail in the complaint. In substance, the complaint alleges that the defendant, who is in the construction business, purchased building materials from the plaintiff and charged the cost thereof to the account of his former employer when he was not authorized by the former employer to do so. The materials were used by the defendant in his own business and he has refused to pay for the materials.

The defendant has been defaulted for failure to appear. The defendant is not in the military service. The court heard the matter as a hearing in damages on May 16, 2006.

The plaintiff has proven compensatory damages of $33,376.98, and is also entitled to an award for punitive damages and attorneys fees based on the defendant's CUTPA violations. Punitive damages are awarded in the amount of $25,000.00. Attorneys fees are awarded in the amount of $4,455.00.

Judgment may enter in the amount of $62,831.98 plus taxable costs.
