Summary
finding that where the insured had been diagnosed with dementia paralytica, "[t]he uncontroverted evidence ... showed that the insured had been treated by a physician for a serious and incurable disease only a short time before the policy was issued, and that he died from this same disease within two years from the date of the issuance of the policy. Without elaboration or any extended discussion it is sufficient to say that, under the evidence, the terms of the policy, and the above-mentioned decisions of this court, the plaintiff was not entitled to recover."
