ORDER


As stated on the record at the conference held on March 9, 2004, it is hereby

ORDERED that, due to the extension of the opt out period, fact discovery of the plaintiffs in the Individual Actions is extended until December 17, 2004.

IT IS FURTHER ORDERED that defendants collectively may take four days (eight hours per day) of deposition testimony of each plaintiff in an Individual Action (including that plaintiff's external investment advisors) where the Individual Action pleads claims solely under the Securities Act. Where the Individual Action's complaint pleads Exchange Act or common law claims, the defendants collectively may take ten days of such testimony of each plaintiff.

IT IS FURTHER ORDERED that the parties shall meet and confer regarding a revised schedule for expert discovery and summary judgment practice in the Individual Actions.

IT IS FURTHER ORDERED that oral argument on the defendants' motion to modify the pre-trial scheduling order will be held on March 24, 2004 at 2:00 p.m. at the United States Courthouse, 500 Pearl Street, New York, New York, in Courtroom 11B.

SO ORDERED.
