MEMORANDUM OPINION


Relator contends the trial judge erred in abating the underlying case. Based on the record presented, we conclude the relator has failed to show the trial judge abused his discretion in abating the underlying case. Accordingly, relator's petition for writ of mandamus is DENIED. See Tex.R.App.P. 52.8(a).
