Original Proceeding on Petition for Writ of Mandamus

MEMORANDUM OPINION

Relator, Mindy Lee Comstock, filed a petition for writ of mandamus seeking to vacate the respondent trial judge's May 5, 2017 oral ruling granting the real party in interest, Allan Ray Comstock's, motion to strike her jury demand. She further asks that we order the respondent judge to conduct a jury trial in the underlying divorce proceeding.

The underlying case is In the Matter of the Marriage of Allan Ray Comstock and Mindy Lee Comstock and In the interest of H. L. C. and J. A. C., Children, cause number 15-FD-3019, pending in the County Court at Law No. 1 of Galveston County, Texas, the Honorable John Grady presiding.

We deny the petition for writ of mandamus and vacate our May 12, 2017 order staying the bench trial. See TEX. R. APP. 52.8, 52.10(b).
