This is a companion case to the suit entitled Humble Oil Refining Company v. Jones, La. App., 125 So.2d 640.

The facts in the case at bar are similar to those in the case of Humble Oil Refining Company v. Jones, supra, with certain exceptions which are not material in the decision of this case.

For the reasons assigned in the case of Humble Oil Refining Company v. Jones, the judgment of the district court is affirmed.

Affirmed.


For the reasons more fully stated in the companion suit rendered this day, Humble Oil Refining Company v. Jones, 125 So.2d 640, I respectfully dissent.

Rehearing denied; TATE, J., dissents.
