Howell v. Hughes

Appellate Division of the Supreme Court of New York, Fourth Department
Jun 24, 1949
275 App. Div. 993 (N.Y. App. Div. 1949)

Opinion

June 24, 1949.

Present — Taylor, P.J., Love, Vaughan, Kimball and Piper, JJ.

Judgments and order reversed on the facts and a new trial granted, with costs to the appellants to abide the event, on the ground that the jury's finding, implicit in the verdict, of the infant plaintiff's freedom from contributory negligence is against the weight of evidence. We find no error in the court's instructions as to the duties and liabilities of the respective defendants. All concur. (The judgment is for plaintiffs in an automobile and school bus negligence action. The order denies a motion for a new trial.)
