ORDER


As of this date, Plaintiff has not filed an opposition to the Motion to Dismiss Under Rule 12(b)(5) for Insufficiency of Service of Process and Motion for Summary Judgment (Rec. Doc. No. 13) filed by the City of New Orleans on August 1, 2005. Thus, in accordance with the Court's Order of January 5, 2006, IT IS ORDERED that the motion is GRANTED. Plaintiff's claims against the City of New Orleans are DISMISSED WITHOUT PREJUDICE.
