Hilton v. Steinman

Appellate Division of the Supreme Court of New York, Second Department
Apr 10, 1950
276 App. Div. 1089 (N.Y. App. Div. 1950)

Opinion

April 10, 1950.

Present — Nolan, P.J., Carswell, Johnston, Adel and Sneed, JJ.

In an action to recover damages for personal injuries suffered by plaintiff's decedent as the result of a collision between the automobile of defendant Steinman and the automobile of defendant Bessel, the jury returned a verdict in favor of plaintiff against defendant Steinman, but in favor of defendant Bessel, and judgment was entered thereon. Defendant Steinman appeals from the judgment against him in favor of plaintiff and in favor of defendant Bessel against plaintiff. Plaintiff appeals from that part of the judgment which is in favor of defendant Bessel and asks for reversal only if the judgment against Steinman is reversed. On appeal by defendant Steinman, the judgment, insofar as it is in favor of plaintiff, is unanimously affirmed, with costs to plaintiff against said defendant. No opinion. The appeal of defendant Steinman from that portion of the judgment which is in favor of defendant Bessel and against plaintiff is dismissed, without costs. ( Ward v. Iroquois Gas Corp., 258 N.Y. 124; Farrington v. 4-12 Water St. Bklyn., Inc., 269 App. Div. 903.) On plaintiff's appeal from the judgment against her and in favor of defendant Bessel, the judgment, insofar as appealed from, is unanimously affirmed, without costs. No opinion.
