Action for the partition of certain real property owned by the plaintiff and the defendant as tenants in common, brought to the Superior Court in the judicial district of Middlesex, where the defendant filed a counterclaim; thereafter, the matter was referred to Hon. Daniel F. Spallone, state trial referee; judgment ordering partition by sale and appointing a committee to conduct the sale, and in favor of the plaintiff on the counterclaim, from which the defendant appealed to this court. Affirmed.
