On the court's own motion this court's order and decision granting leave to appeal dated January 12, 1989 [ 73 N.Y.2d 704] vacated unless within 20 days appellants, if they be so advised, serve upon respondent and file in this court a notice that they have abandoned their appeal to the Appellate Division, and stipulate for the withdrawal of that appeal (Parker v Rogerson, 35 N.Y.2d 751).

Chief Judge WACHTLER and Judge KAYE taking no part.
