The judgment of the trial court is reversed and a judgment rendered for the defendant on the authority of Ex parte Hardley, [Ms. 1972074, December 30, 1999], 766 So.2d 154 (Ala. 1999).

REVERSED AND JUDGMENT RENDERED.
