ORDER


For the reasons stated in the accompanying Memorandum, it is hereby Ordered that:

1. the defendants' motions to dismiss, or for summary judgment (docket entry nos. 46, 49), are GRANTED;
2. the Bendos firm's motion to strike service and to dismiss action (docket entry no. 48) is DENIED as moot;
3. this case is Dismissed for lack of subject matter jurisdiction;

4. the Clerk shall CLOSE this case; and

5. copies of this Order and the accompanying Memorandum shall be sent to counsel of record.
