PLEADING, § 174admissions by motion to dismiss. The allegations in the complaint which charged that plaintiff made certain advances to the defendant for the purpose of engaging in business, and defendant agreed to repay same, and plaintiff was to share in the business engaged in by defendant, and the defendant refused to account for any proceeds and that all property in which defendant had any interest was represented by money obtained from plaintiff or from the use of plaintiff's money, were admitted by defendant's motion to dismiss the complaint, and plaintiff was entitled to an accounting.

Appeal from Superior Court of Cook county; Hon. JOHN C. LEWE, presiding.

Decree affirmed. Heard in third division, first district, this court at June term, 1941.
