ORDER TO AMEND :

Plaintiff, appearing pro se, brings this action invoking the Court's diversity jurisdiction, 28 U.S.C. § 1332. By order dated April 1, 2020, the Court granted Plaintiff's request to proceed without prepayment of fees, that is, in forma pauperis. For the reasons set forth below, the Court grants Plaintiff leave to file an amended complaint within sixty days of the date of this order.

STANDARD OF REVIEW

The Court must dismiss an in forma pauperis complaint, or any portion of the complaint, that is frivolous or malicious, fails to state a claim on which relief may be granted, or seeks monetary relief from a defendant who is immune from such relief. 28 U.S.C. § 1915(e)(2)(B); see Livingston v. Adirondack Beverage Co., 141 F.3d 434, 437 (2d Cir. 1998). The Court must also dismiss a complaint when the Court lacks subject matter jurisdiction. See Fed. R. Civ. P. 12(h)(3).

While the law mandates dismissal on any of these grounds, the Court is obliged to construe pro se pleadings liberally, Harris v. Mills, 572 F.3d 66, 72 (2d Cir. 2009), and interpret them to raise the "strongest [claims] that they suggest," Triestman v. Fed. Bureau of Prisons, 470 F.3d 471, 474 (2d Cir. 2006) (internal quotation marks and citations omitted) (emphasis in original). But the "special solicitude" in pro se cases, id. at 475 (citation omitted), has its limits - to state a claim, pro se pleadings still must comply with Rule 8 of the Federal Rules of Civil Procedure, which requires a complaint to make a short and plain statement showing that the pleader is entitled to relief.

The Supreme Court has held that under Rule 8, a complaint must include enough facts to state a claim for relief "that is plausible on its face." Bell Atl. Corp. v. Twombly, 550 U.S. 544, 570 (2007). A claim is facially plausible if the plaintiff pleads enough factual detail to allow the Court to draw the inference that the defendant is liable for the alleged misconduct. In reviewing the complaint, the Court must accept all well-pleaded factual allegations as true. Ashcroft v. Iqbal, 556 U.S. 662, 678-79 (2009). But it does not have to accept as true "[t]hreadbare recitals of the elements of a cause of action," which are essentially just legal conclusions. Twombly, 550 U.S. at 555. After separating legal conclusions from well-pleaded factual allegations, the Court must determine whether those facts make it plausible - not merely possible - that the pleader is entitled to relief. Id.

BACKGROUND

In May 2018, HBO West Coast Programming LLC (HBO) and Central Casting LLC hired Plaintiff Abraham Gross as a "stand in" for the filming of the show Crashing. Nicole Payson was Plaintiff's direct supervisor, and Rob Brofman, HBO Senior Vice President, was listed on the Daily Call Sheet as the contact person.

During the three months that Plaintiff worked on the film, Ms. Payson berated him and engaged in unwarranted harassment, including falsely accusing Plaintiff of being late even though he was not late. Ms. Payson also falsely reported to her supervisors on several occasions that Plaintiff had disobeyed instructions, even though he had not done so. In addition, she took "humiliating" photos of Plaintiff and shared them with others and required him to "taste food in order to see if it was spoiled."

On July 9, 2018, Plaintiff asked Ms. Payson not to scream at him for no reason. In response, Ms. Payson falsely claimed that Plaintiff had been insubordinate. The following day, Plaintiff was fired. Plaintiff had witnesses who supported his version of events, but HBO failed to take appropriate action. Since that time, Plaintiff "has been blacklisted" and has been unable to find work because Ms. Payson "took active measures to ensure [that he] would not be hired on future projects."

Plaintiff filed a complaint with the New York State Division of Human Rights, on the ground that "all male coworkers were subjected to harassment." He received a Notice of Right to Sue from the Equal Employment Opportunity Commission (EEOC). Plaintiff brings this complaint under the Court's diversity jurisdiction, 28 U.S.C. § 1332, naming HBO, Brofman, and Central Casting LLC as Defendants.

DISCUSSION

The subject matter jurisdiction of the federal district courts is limited and is set forth generally in 28 U.S.C. §§ 1331 and 1332. Under these statutes, federal jurisdiction is available only when a "federal question" is presented or when plaintiff and defendant are citizens of different states and the amount in controversy exceeds the sum or value of $75,000. "'[I]t is common ground that in our federal system of limited jurisdiction any party or the court sua sponte, at any stage of the proceedings, may raise the question of whether the court has subject matter jurisdiction.'" United Food & Commercial Workers Union, Local 919, AFL-CIO v. CenterMark Prop. Meriden Square, Inc., 30 F.3d 298, 301 (2d Cir. 1994) (quoting Manway Constr. Co., Inc. v. Hous. Auth. of the City of Hartford, 711 F.2d 501, 503 (2d Cir. 1983)); see Fed. R. Civ. P. 12(h)(3) ("If the court determines at any time that it lacks subject-matter jurisdiction, the court must dismiss the action."); Ruhrgas AG v. Marathon Oil Co., 526 U.S. 574, 583 (1999) ("[S]ubject-matter delineations must be policed by the courts on their own initiative . . . .").

To establish jurisdiction under 28 U.S.C. § 1332, a plaintiff must first allege that the plaintiff and the defendant are citizens of different states. Wis. Dep't of Corr. v. Schacht, 524 U.S. 381, 388 (1998). An individual's citizenship, within the meaning of the diversity statue, is determined by his domicile." Johnson v. Smithsonian, 4 Fed. App'x 69, 70 (2d Cir. 2001) (citing Palazzo v. Corio, 232 F.3d 88, 42 (2d Cir. 2000)). A corporation is a citizen of both the State where it is incorporated and the State where it has its "nerve center," usually its headquarters. Hertz Corp. v. Friend, 559 U.S. 77, 93 (2010). A limited liability corporation (LLC) "takes the citizenship of each of its members" for diversity purposes. Bayerische Landesbank v. Aladdin Capital Mgmt. LLC, 692 F.3d 42, 49 (2d Cir. 2012).

Plaintiff alleges that he is a citizen of New York. (ECF 2 at 2), and that Defendant HBO West Coast Programming, LLC, is incorporated in Delaware and has its principal place of business in California (id. at 3). If HBO West Coast Programming, LLC, is a limited liability corporation, then Plaintiff must identify the members of the LLC and plead facts about the citizenship of the members of the LLC. Likewise, Plaintiff provides an address for Central Casting LLC in Burbank, California, but he also does not identify the members of that LLC or plead facts about the citizenship of the members of Central Casting LLC. Plaintiff lists an address for Defendant Brofman at work at HBO West Coast Programming, LLC, but does not allege that Brofman is domiciled in California. Plaintiff thus fails to plead facts showing complete diversity of citizenship.

In addition to pleading that the parties are of diverse citizenship, in order to establish diversity jurisdiction, a plaintiff must allege to a "reasonable probability" that the claim is in excess of the sum or value of $75,000.00, the statutory jurisdictional amount. See 28 U.S.C. § 1332(a); Colavito v. N.Y. Organ Donor Network, Inc., 438 F.3d 214, 221 (2d Cir. 2006). Here, Plaintiff does not plead any facts about his lost wages or identify the damages that he seeks, and he thus fails to show that the amount in controversy is satisfied.

District courts generally grant a pro se plaintiff an opportunity to amend a complaint to cure its defects unless it would be futile to do so. See Hill v. Curcione, 657 F.3d 116, 123-24 (2d Cir. 2011); Salahuddin v. Cuomo, 861 F.2d 40, 42 (2d Cir. 1988). Moreover, courts generally must allow a plaintiff to amend a complaint to drop a defendant whose inclusion destroys diversity jurisdiction, unless the individual is an indispensable party under Rule 19 of the Federal Rules of Civil Procedure. Jaser v. New York Prop. Ins. Underwriting Ass'n, 815 F.2d 240, 243 (2d Cir. 1987) (holding that generally a district court should allow a plaintiff "to drop dispensable nondiverse defendants whose presence would defeat diversity of citizenship."). The Court therefore grants Plaintiff leave to amend his complaint to plead facts establishing that the Court can exercise diversity jurisdiction over this matter.

Alternatively, Plaintiff may be able to show that the Court has federal question jurisdiction. To invoke federal question jurisdiction, a plaintiff's claims must arise "under the Constitution, laws, or treaties of the United States." 28 U.S.C. § 1331. A case arises under federal law if the complaint "establishes either that federal law creates the cause of action or that the plaintiff's right to relief necessarily depends on resolution of a substantial question of federal law." Bay Shore Union Free Sch. Dist. v. Kain, 485 F.3d 730, 734-35 (2d Cir. 2007) (quoting Empire Healthchoice Assur., Inc. v. McVeigh, 547 U.S. 677, 690 (2006)).

Plaintiff does not allege that the Court has federal question jurisdiction over this matter, but his complaint might be liberally construed as asserting claims under Title VII of the Civil Rights Act (Title VII). Title VII provides that "[i]t shall be an unlawful employment practice for an employer ... to fail or refuse to hire or to discharge any individual, or otherwise to discriminate against any individual with respect to his compensation, terms, conditions, or privileges of employment, because of such individual's race, color, religion, sex or national origin." 42 U.S.C. § 2000e-2(a).

Title VII prohibits an employer from mistreating an individual because of the individual's protected characteristics, Patane v. Clark, 508 F.3d 106, 112 (2d Cir. 2007), or retaliating against an employee who has opposed any practice made unlawful by those statutes, see Crawford v. Metro. Gov't, 555 U.S. 271, 276 (2009) (holding that conduct is protected when it "confront[s]," "resist[s]," or "withstand[s]" unlawful actions). But mistreatment at work that occurs for a reason other than an employee's protected characteristic or opposition to unlawful conduct is not actionable under these federal antidiscrimination statutes. See Chukwuka v. City of New York, 513 F. App'x 34, 36 (2d Cir. 2013) (quoting Brown v. Henderson, 257 F.3d 246, 252 (2d Cir. 2001)).

At the pleading stage in an employment discrimination action, "a plaintiff must plausibly allege that (1) the employer took adverse employment action against him, and (2) his race, color, religion, sex, or national origin was a motivating factor in the employment decision." Vega v. Hempstead Union Free Sch. Dist., 801 F.3d 72, 86 (2d Cir. 2015). The plaintiff "may do so by alleging facts that directly show discrimination or facts that indirectly show discrimination by giving rise to a plausible inference of discrimination." Id. at 87.

Here, Plaintiff alleges that his supervisor mistreated him and other men at work. As an initial matter, it is unclear from the allegations in the complaint if Plaintiff qualified as an employee of either HBO West Coast Programming LLC or Central Casting LLC, for purposes of Title VII. See Eisenberg v. Advance Relocation & Storage, Inc., 237 F.3d 111, 113 (2d Cir. 2000) ("Title VII cover[s] 'employees,' not independent contractors"). If Plaintiff contends that he was an employee and that he was fired because of discrimination on the basis of sex, he may be able to amend his complaint to plead a claim under Title VII.

Plaintiff has named an individual defendant in his original complaint. The Court notes that because Title VII does not provide for individual liability, Tomka v. Seiler Corp., 66 F.3d 1295, 1317 (2d Cir. 1995), the employer is the proper defendant for a Title VII action. Nevertheless, an individual "who actually participates in the conduct giving rise to the discrimination claim may be held personally liable" under the New York State Human Rights Law. Feingold v. New York, 366 F.3d 138, 158 n.19 (2d Cir. 2004).

LEAVE TO AMEND

Plaintiff is granted leave to amend his complaint to detail his claims. In the statement of claim, Plaintiff must provide a short and plain statement of the relevant facts supporting each claim against each defendant named in the amended complaint. Plaintiff is also directed to provide the addresses for any named defendants. To the greatest extent possible, Plaintiff's amended complaint must:

a) give the names and titles of all relevant persons;

b) describe all relevant events, stating the facts that support Plaintiff's case including what each defendant did or failed to do;

c) give the dates and times of each relevant event or, if not known, the approximate date and time of each relevant event;

d) give the location where each relevant event occurred;

e) describe how each defendant's acts or omissions violated Plaintiff's rights and describe the injuries Plaintiff suffered; and

f) state what relief Plaintiff seeks from the Court, such as money damages, injunctive relief, or declaratory relief.

Essentially, the body of Plaintiff's amended complaint must tell the Court: who violated his federally protected rights; what facts show that his federally protected rights were violated; when such violation occurred; where such violation occurred; and why Plaintiff is entitled to relief. Because Plaintiff's amended complaint will completely replace, not supplement, the original complaint, any facts or claims that Plaintiff wishes to maintain must be included in the amended complaint.

CONCLUSION

Plaintiff is granted leave to file an amended complaint that complies with the standards set forth above. Plaintiff must submit the amended complaint to this Court's Pro Se Intake Unit within sixty days of the date of this order, caption the document as an "Amended Complaint," and label the document with docket number 20-CV-2675 (LLS). An Amended Complaint form is attached to this order. No summons will issue at this time. If Plaintiff fails to comply within the time allowed, and he cannot show good cause to excuse such failure, the complaint will be dismissed for failure to state a claim upon which relief may be granted.
