Defendant, by Notice of Motion dated June 15, 2006, has moved this Court for an Order permitting it to reargue its prior motion for summary judgment which was denied by this Court by decision and order dated March 21, 2006. Plaintiffs' counsel has contacted chambers and they rely upon the original papers submitted on the motion and this Court's decision on those motions.

DECISION

The Court has considered the arguments made by the Defendant, but is compelled, for those reasons stated in its earlier decision to adhere to the original determination.

ORDER

ORDERED that Defendant's Motion (Mot. # 004) is denied; and it is further

ORDERED that Plaintiff is directed to serve a copy of this decision and order together with a notice of entry upon all other parties to this action, forthwith.

The foregoing shall constitute the decision and order of the court.
