APPEAL AND ERROR, § 42dismissal of appeal from order not final. Where record discloses that an appeal is attempted to be taken from an order which is not final, Appellate Court is bound of its own motion to dismiss appeal, notwithstanding appellee fails to make motion to dismiss.
