JUDGMENT


It is ORDERED, ADJUDGED, and DECREED that this action be and is hereby REMANDED for lack of subject matter jurisdiction to the District Court of Mobile County, Alabama.

ORDER

After due and proper consideration of all portions of this file deemed relevant to the issue raised, and there having been no objections filed, the Report and Recommendation of the Magistrate Judge made under 28 U.S.C. § 636(b)(1)(A) is ADOPTED as the opinion of this Court. It is ORDERED that Plaintiff's action be REMANDED to the District Court for Mobile County, Alabama, for lack of subject matter jurisdiction. The Clerk is DIRECTED to send a certified copy of this Order to the Clerk of the District Court of Mobile County, Alabama. See 28 U.S.C. § 1447(c).
