APPEAL FROM THIRTEENTH JUDICIAL DISTRICT COURT, PARISH OF EVANGELINE, STATE OF LOUISIANA.


Granted. The judgment of the trial court is set aside. A suit for damages for retaliatory discharge under La.R.S. 23:1361 does not fall within La.C.C.P. art. 1732's prohibition of a jury trial in "[a] . . . worker's compensation . . . proceeding".

DENNIS, J., would grant the writ.

WATSON, J., dissents from the order.
