Opinion

No. 18280.

June 11, 1945.

Appeal from Civil District Court, Parish of Orleans; Harold A. Moise, Judge.

Luke Cutrera, of New Orleans, for plaintiff-appellant.

Jones, Flanders Waechter, J. Mort Walker, Jr., and Elmer D. Flanders, all of New Orleans, for defendants-appellees.

This suit arises out of the same accident which we discussed in the matter of Giorlando v. Maitrejean and Liberty Mutual Insurance Corporation, 22 So.2d 564.

Our reasons for affirming the judgment dismissing this suit are given in that other case, 22 So.2d 564.

It is therefore ordered, adjudged and decreed that the judgment appealed from be, and it is, affirmed at the cost of appellant.

Affirmed.

WESTERFIELD, J., absent, takes no part.
