Felipe v. Allstate Ins. Co.

District Court of Appeal of Florida, Third District
Dec 30, 1998
721 So. 2d 839 (Fla. Dist. Ct. App. 1998)

Opinion

No. 98-1977.

December 30, 1998.

A Writ of Certiorari to the Circuit Court for Dade County, Steve Levine, Judge.

Ross Tilghman and Lauri Waldman Ross, Miami, for petitioners.

Angones, Hunter, McClure, Lynch Williams, P.A., and Christopher Lynch, Miami, for respondent.

Before JORGENSON, GERSTEN and SHEVIN, JJ.

Confession of Error

Rene Felipe and Elsa Felipe seek certiorari review of an order disqualifying their appraiser in an arbitration proceeding. Upon the insurer's correct and commendable confession of error, we grant the petition and quash the order of disqualification. See Galvis v. Allstate Ins. Co., No. 98-1599, 721 So.2d 421 (Fla. 3d DCA 1998) (holding that disqualification of party's selected appraiser based upon appraiser's mode of compensation constitutes departure from essential requirements of law).

Petition granted; order quashed; remanded for further proceedings consistent with this opinion.
