Appeal, No. 441, Oct. T., 1959, from judgment of Municipal Court of Philadelphia County, Sept. T., 1957, No. 1353, in case of William Falconer v. Samuel Mazess. Judgment affirmed; reargument refused July 18, 1960.

Assumpsit and counterclaim by defendant. Before JONES, J., without a jury.

Findings entered for plaintiff in original action and on counterclaim, and judgment entered thereon. Defendant appealed.

Argued June 14, 1960.


The six judges who heard the argument in this case being equally divided in opinion, the judgment is affirmed.
