ORDER AND REASONS


Pending before this Court in the above-captioned matter are Defendant, Robert S. Cunard, Jr.'s Motion to Set Motion for Summary Judgment for Hearing (Doc. 103) and Defendants' Motion to Stay District Court Proceedings Pending Appeal (Doc. 105). Said motions were set for hearing this day, without oral argument. The Plaintiff opposes both motions.

In a minute entry dated November 1, 2000, this Court ordered that all proceedings in the above-captioned matter be stayed pending action by the Court of Appeals for the Fifth Circuit with respect to the Defendants' Petition for Appeal of the order certifying this matter as a class action.

Accordingly,

IT IS ORDERED, that Robert S. Cunard, Jr.'s Motion to Set Motion for Summary Judgment for Hearing (Doc. 103) be, and the same is hereby DENIED AT THIS TIME.

IT IS FURTHER ORDERED, that the Defendants' Motion to Stay District Court Proceedings Pending Appeal (Doc. 105) be, and the same is hereby deemed MOOT pursuant to the Order of this Court dated November 1, 2000.
