[No. 32, October Term, 1935.]

Decided December 4th, 1935.

Motor Truck — Injury to Pedestrian on Sidewalk.

Plaintiff's testimony that defendant's truck, as it turned a street corner where plaintiff was standing on the sidewalk, passed so close to the sidewalk that the projecting body of the truck struck him, held sufficient to go to the jury, in spite of testimony for defendant that plaintiff was injured by stepping off the sidewalk and against the side of the truck.

Decided December 4th, 1935.

Appeal from the Superior Court of Baltimore City (DUKE BOND, J.).

Action by William Rainey against Robert H. Epps. From a judgment for plaintiff, defendant appeals. Affirmed.

The cause was submitted on briefs to BOND, C.J., URNER, OFFUTT, PARKE, SLOAN, MITCHELL, SHEHAN, and JOHNSON, JJ.
