Dupre v. Darbonne

Court of Appeal of Louisiana, Third Circuit
Sep 19, 1972
266 So. 2d 556 (La. Ct. App. 1972)

Opinion

No. 3957.

September 19, 1972.

Appeal from 13th Judicial District Court, Parish of Evangeline; Joe R. Vidrine, Judge.

Lewis Lewis, by Seth Lewis, Jr., Opelousas, for defendant-appellant.

Preston N. Aucoin, Ville Platte, for plaintiff-appellee.

Before SAVOY, HOOD and CULPEPPER, JJ.

This case is consolidated with Dupre v. Darbonne, 266 So.2d 553, in which a separate judgment is being rendered. For the reasons stated in our decision in that case, the judgment appealed in the present matter is reversed and set aside. Judgment is now rendered in favor of defendant and against the plaintiffs dismissing their suit at their cost. All costs in the trial and appellate courts are assessed against plaintiffs.

Reversed and rendered.
