The petition for leave to appeal is allowed. In this cause the plaintiff filed a complaint on March 29, 1982, against the defendant railroad under the Federal Employers' Liability Act ( 45 U.S.C. § 51 et seq. (1982)) to recover damages for injuries sustained near Covington, Kentucky. On April 22, 1982, defendant filed a motion to dismiss on grounds of forum non conveniens; the circuit court of St. Clair County denied the motion on May 26, 1982. Rule 306(a)(1)(ii), providing for a discretionary interlocutory appeal to the appellate court from the denial of a motion to dismiss on forum non conveniens grounds, became effective on April 1, 1982 (94 Ill.2d R. 306(a)(1)(ii)).
