Although this appeal involves a claim that the plaintiff was wrongfully discharged for exercising rights under the Federal Employers' Liability Act ( 45 U.S.C. § 51 et seq.) rather than the Workers' Compensation Act (Ill. Rev. Stat. 1983, ch. 48, par. 138.1 et seq.), we consider the question to be comparable to that decided in Midgett v. Sackett-Chicago, Inc. (1984), 105 Ill.2d 143. Accordingly, in the exercise of this court's supervisory jurisdiction, the judgment of the Appellate Court, Fifth District ( 123 Ill. App.3d 1038), is reversed, and the cause is remanded to the circuit court of St. Clair County for further proceedings consistent with the decision in Midgett. (60475) Krhounek v. Krhounek ....................................... Allowed with order. The petition for leave to appeal is allowed. In the exercise of this court's supervisory jurisdiction, the Appellate Court, Second District, is ordered to vacate its order of June 6, 1984, dismissing the appeal of George Joseph Krhounek, Jr., in Krhounek v. Krhounek, No. 2-84-0236. The appellate court is further ordered to grant George Joseph Krhounek, Jr., 30 days from the entry of this order for filing the report of proceedings.
