In a medical malpractice action, defendant appeals from an order of the Supreme Court, Nassau County, entered July 26, 1977, which denied its motion to dismiss the complaint. Order affirmed, without costs and disbursement, on the opinion of Mr. Justice Niehoff at Special Term. Mollen, P.J., Latham, Suozzi, Gulotta and Cohalan, JJ., concur. [ 91 Misc.2d 53.]
